Approval and application context

The notes below help you assess the scope and conditions. The regulatory text and its exceptions govern your application.

I am placing machinery on the market for the first time. Which rules apply, and until when?

Apply the 2006/42/EC rules to machinery placed on the market before 20 January 2027. From that date, apply 2023/1230 to newly placed machinery.

  • Under the old rules, machinery outside Annex IV uses internal checks. For Annex IV machinery, the route depends on whether harmonised standards covering all relevant safety requirements are applied.
  • For Annex I Part A machinery, use a notified body for type examination with production checks (B+C), quality-system assessment (H), or examination of the individual product (G). Part B allows your own production checks (A) only if you meet harmonised standards or common specifications covering all relevant safety requirements; otherwise use B+C, H or G. Machinery outside the list uses your own production checks (A).
  • Partly completed machinery follows separate documentation and assembly-instruction requirements; this is not the CE procedure for a complete machine.

Identify your product’s list entry, conformity-assessment route and market-placement date. Prepare the technical file accordingly.

What is the latest legislation, and when must I apply it?

The latest legislation is 2023/1230. Its general product requirements apply from 20 January 2027.

  • The Regulation entered into force on 19 July 2023. Some provisions apply earlier; the general product application date remains 20 January 2027.
  • 20 January 2027 is not the expiry date of every existing document. The product’s market-placement date and the certificate’s own validity period also matter.

Prepare the design, technical documentation and declarations for products placed on the market from 20 January 2027 under the new requirements.

Must I update my existing product or documents, and by when?

Products lawfully placed on the market under the old rules before 20 January 2027 may continue to be made available. EC type-examination certificates and approval decisions issued under those rules remain valid until they expire.

  • Manufacturing stock alone is not enough: the product must have been placed on the market before 20 January 2027.
  • This transition does not prevent action against unsafe products. The date alone does not require every machine already in use to be recertified.

Check each product’s first market-placement date and any certificate expiry. Distinguish newly placed products from stock protected by the transition.
